On July 6, 2009 Judge Nathaniel Poovey ordered this capital trial to be moved to Catawba County due to extensive and prejudicial pretrial publicity. Attorneys Mark R. Melrose and Randal Seago were successful having the entire case moved out of the mountains for trial. This is believed to be the greatest distance a Haywood County case has ever been moved for trial due to pretrial publicity. Asheville Citizens Times Article
